Board of Adjustment

The Teller County Board of County Commissioners also serves as the Teller County Board of Adjustment (BOA).

The BOA is a public governmental body appointed to consider specific appeals and variances of land use decisions or interpretations given demonstration of a hardship or practical difficulty (see Section 1.11, 1.12 and 1.14 of the Teller County Land Use Regulations). They hear and decide on certain appeals of decisions made by an Administrative Official or the Teller County Planning Commission, and they hear and decide on certain requests for special exceptions to zoning limitations, flood hazard regulations, and Zone District Map and regulation interpretations. The BOA cannot change land use, and therefore variances, if granted, do not constitute a rezoning. Decisions of the BOA are final and binding although an appeal of a BOA decision may be made through District Court.
